By accessing this website and/or placing an order, you acknowledge and agree to be bound by the terms and conditions outlined below.   1. Availability of Art Works: All art orders placed through the Hart Gallery website are subject to the availability of the artworks at the time of receipt and order acceptance.

  2. Order Acceptance and Ownership: Acceptance of orders for art works is subject to the clearance of funds and, if applicable, authorization of debit and/or credit card details. The art work remains the property of Hart Gallery until cleared funds are received. Hart Gallery reserves the right to sell the art work to other parties until such funds are received.

  3. Jurisdiction: These terms and conditions, as well as all other matters related to Hart Gallery websites, are governed by the laws of Ireland, and any disputes shall be subject to the jurisdiction of the Irish courts.

  4. Importation Taxes and Charges: Customers who purchase art work from Hart Gallery are responsible for any taxation or charges imposed on the importation of the ordered art works.

  5. Copyright: The copyright for all images and art works purchased or featured on the Hart Gallery website belongs to the respective artists and the gallery. No party may reproduce such images without permission.

  6. Currency and Exchange Rates: Art purchases will be processed in Euros, and the prevailing exchange rate of our clearing merchant bank will apply. Any approximate conversion rate information provided in foreign currency is for general guidance only.

  7. Unauthorized Card Use: In the event that a customer’s credit or debit card is used without authorization or improperly used to purchase art work, the customer is obligated to return the art work immediately.

  8. Customer Responsibility: By making art purchases from Hart Gallery, customers warrant that they have the authority to do so in their own name and that they are 18 years of age or older.

  9. Art Work Returns: Hart Gallery wants customers to be completely satisfied with their art work purchases. Therefore, customers may cancel an order within 7 days of receiving the art work and receive a full refund, subject to the following conditions:

  • Customers must notify Hart Gallery in writing of the cancellation within 7 days of art work delivery.
  • Customers are responsible for the cost of returning the art work, which should be sent back in its original condition, along with the packaging and all relevant documentation.
  • Art work returns must be made within 14 days of notifying Hart Gallery. Customers are advised to keep all receipts and use a reliable shipping method with proof of postage, proof of receipt, and adequate insurance to cover loss or damage. Once the cancellation and return process has been completed as outlined above, Hart Gallery will issue a full refund for the art work’s purchase price, excluding any delivery charges. Customers are responsible for the carriage and insurance costs associated with returns.

  1. Prices and Charges: All advertised prices include Irish taxes and are based on art works collected from Hart Gallery. Additional charges will apply to customers who require delivery of art works, covering packing, postage, and insurance, except for deliveries within Ireland. Accepted payment methods include bank transfer and debit cards. Visa and Mastercard credit cards are also accepted. Please confirm international postage rates before finalizing your art work order.

  2. Privacy: Hart Gallery treats all Personal Information provided by customers as confidential. This information will be stored securely on a server and will be used in full compliance with applicable Irish Data Protection and consumer legislation.
